Commercial Auto

Whether you have a manager that makes bank deposits or a delivery driver dropping off customer orders, is your business protected from any liabilities that arise from employees on the road through the course of business?

Because most franchises and restaurants do not have a fleet of owned vehicles, it’s very common to not carry any coverage for auto liabilities. Many business owners rely on the insurance policies of each individual driver to provide coverage in the event of an at-fault accident.

But is it enough?

Accidents are bound to occur on the road. LexisNexis Risk Solutions estimates claims severity continues to rise in bodily injury and property damage (9.2% and 2.5% year over year, respectively), and frequency of violations/claims have become the norm.

Many personal auto policies limit the liability payouts for bodily injury and property damage at around $100,000 per accident, and with the rise in litigation in recent years, many businesses are being hit with frivolous lawsuits designed to maximize payout for the injured party.

Commercial auto policies provide a much higher limit of liability for the insurance company to step in and provide assistance to business owners (typically written at around $1,000,000 combined for property damage and bodily injury).

To mitigate this, many of our clients have begun carrying what is known as Hired and Non-Owned Auto Coverage as an enhancement to their general liability. It is a great way to insulate your business from unnecessary out of pocket expense, and can be very cost-effective.

Are you carrying the right coverages? Let us evaluate your policies to help recommend the best coverages for your business.

Commercial Property

Whether you own or rent the building(s) you operate out of, commercial property coverage is important for your building, contents, and stock.

Property coverages for franchises and restaurants have unique components that every owner needs to be aware of.

Is your agent educating you on:

Crime Coverage?

Protect your business from financial threats resulting from criminal acts including employee theft, forgery or alteration, computer fraud, funds transfer fraud, social engineering fraud, and many others

Blanket vs. Scheduled Property Coverage?

  • Scheduled coverage names each building and the limit of insurance associated with individual structures
  • Blanket coverage states a total dollar amount of coverage for all buildings, and each building falls into that blanket amount
  • Do you know which coverage is best for your insurance environment?

Let us help you determine the best options

Business Income Coverage?

  • Protect your income from interruptions to your business operations due to a covered claim
  • When business stops because a shop is unable to operate, your insurance policy can help replace that lost income. When was the last time you received an evaluation on just how much Business Income coverage is right for you?

Employee Benefits Liability

What is Employee Benefits Liability (EBL)?

EBL protects businesses from out-of-pocket expenses arising from errors or omissions in the administration of employee benefits programs, including health, life, disability, retirement, and many other benefits.

Examples of Covered Benefits Errors

  • Failure to enroll an employee in health insurance plan benefits
  • Incorrectly calculating retirement plan contributions
  • Providing erroneous information about employee benefit eligibility
  • Installation of client goods i.e. cabinets, siding, etc.

Why is this important for restaurants and franchises?

If you are providing any level of employee benefits in your business, errors are often unavoidable. To prevent large out-of-pocket expenses, EBL coverage can help protect your business.

Professional Liability

Are you a design-build contractor? Do you provide consulting, engineering, architectural, or construction management services?

If so, Professional Liability is an important line of insurance to carry, whether you are directly involved or subcontract out your design needs.

Also called “Errors and Omissions” insurance, Professional Liability provides important coverages for:

  • Negligence and Errors
  • Omissions
  • Defense Costs
  • Settlements and Judgments

Whether you are currently carrying a Professional Liability policy or not, it’s important to understand the coverages provided and how it can be utilized in your business.

Management Liability

What is Management Liability?

Insurance that protects a company and its executives from various risks associated with running a business. Management Liability can help cover losses from lawsuits, investigations, and other claims related to mismanagement, employee disputes, and criminal acts.

Types of Management Liability Insurance

  • Directors & Officers (D&O)
  • EPLI
  • Fiduciary Liability
  • Crime
  • Cyber

Employment Practices Liability

What is Employment Practices Liability Insurance (EPLI)?

EPLI provides protection from financial loss due to employment-related lawsuits. Examples include:

  • Discrimination
  • Wrongful Termination
  • Harassment
  • Retaliation
  • Failure to Promote
  • Breach of Contract

Why is this important for franchises and restaurants?

Due to the nature of employee turnover and part-time work in the industry, lawsuits for the above reasons have become much more common in recent years.

EPLI insurance is a very cost-effective way to protect your business and insulate risk against these types of risk.

Fidelity Bonding – ERISA Bond

The Employee Retirement Security Act of 1974 (ERISA) is a federal law that protects employee benefit plans.

Part of this law, and one of its crucial components, is fidelity bonding, also known as ERISA Bonds.

These bonds protect the employee plan and its participants against fraud or dishonesty by those handling the funds. This can include administrators, trustees, and certain service providers.

If you have bonding needs, let us show you a better way to incorporate into your insurance portfolio.

Excess/Umbrella Liability

What is umbrella or excess liability coverage?

  • Liability coverage to sit in addition to the limits of liability present in General Liability, Auto Liability, Employers Liability (workers’ compensation), Professional Liability, Product Liability, Cyber Liability, and/or Liquor Liability (considered “underlying” policies)
  • Umbrella is considered an “overlying” policy that takes effect once the limits of the underlying policies have been exhausted
  • Example: if we have a $1 million limit per occurrence on General Liability, any claim that exceeds that amount would incur out-of-pocket expenses without the umbrella. With an umbrella policy, any amount over the underlying policy limit would be covered up to the amount of coverage selected by the umbrella policy

Why do Franchise and Restaurants need this coverage?

  • Average General Liability claim can easily exceed $1 million in total cost (including damages, legal/defense costs, etc.), and the umbrella ensures you are protected against out-of-pocket claims expenses
  • Litigation has become more common in today’s landscape – umbrella/excess liability coverage further insulates your business and assets from legal action

Cyber

Since the pandemic, the insurance industry has seen a significant increase in frequency of claims on Cyber Insurance policies.

Whether Business Email Compromise, Ransomware, or Electronic Funds Transfer fraud, it’s more important than ever that you cover not just your own sensitive information, but that of your customers.

The two main segments of Cyber Insurance are:

First Party Cyber Insurance

  • Covers your business’ direct losses from a cyber incident affecting your own systems, networks, or data
  • Among other coverages, First Party Cyber Insurance provides relief from financial losses, data and asset recover, crisis management

Third Party Cyber Insurance

  • Provides liability protection in case a data breach or cyber incident at your company leads to claims or lawsuits from external parties
  • Protects your business from financial liabilities and legal expenses resulting from harm caused to clients, vendors, or other third parties due to a cyber incident involving your systems
