General Liability

Protects the institution against claims of bodily injury or property damage that occur on its premises or due to its general operations, excluding professional instructional activities or specific student/employee interactions. Examples include a visitor slipping on a wet floor, a non-student guest being injured during an event, or property damage caused by a school-sponsored activity off-campus (e.g., a field trip, but not related to professional instruction).

Commercial Auto

Covers vehicles owned by the educational institution (e.g., school buses, vans for athletic teams, facilities maintenance vehicles). It provides coverage for bodily injury and property damage you cause to others in an accident, as well as damage to your own vehicles, and medical payments for occupants, depending on the specific coverages purchased.

Hired/Non-Owned Auto (HNOA):

This crucial add-on or specific coverage within Commercial Auto extends liability protection for vehicles your institution does not own but uses for business purposes.

  • Hired Auto: Covers vehicles the school leases, rents, or borrows for official use (e.g., renting a bus for a field trip or an athletic event).
  • Non-Owned Auto: Covers vehicles owned by employees, volunteers, or students but used for official school business (e.g., a teacher driving their personal car for a school errand, a coach driving students to an away game in their own car, or parent volunteers driving for school events).

Commercial Property

Covers the physical assets of the educational institution, including academic buildings, dormitories, administrative offices, athletic facilities, libraries, classrooms, equipment (e.g., computers, lab instruments), books, and supplies, against perils like fire, theft, vandalism, and natural disasters. It covers the cost to repair or replace damaged property.

Professional Liability

For educational institutions, this covers claims alleging negligence, errors, or omissions in the professional services provided, such as teaching, counseling, advising, and administrative duties. This could include claims arising from curriculum design flaws, negligent supervision (not covered by general liability for students), improper student placement, or inadequate counseling that leads to harm. It protects against financial loss due to alleged professional mistakes.

Also called “Errors and Omissions” insurance, Professional Liability provides important coverages for:

  • Negligence and Errors
  • Omissions
  • Defense Costs
  • Settlements and Judgments

Whether you are currently carrying a Professional Liability policy or not, it’s important to understand the coverages provided and how it can be utilized in your business.

Employment Practices Liability

What is Employment Practices Liability Insurance (EPLI)?

EPLI protects the institution against claims made by current, former, or prospective employees (faculty, staff, administrators) alleging wrongful acts related to their employment. Examples include:

  • Discrimination
  • Wrongful Termination
  • Harassment/Sexual Harassment
  • Retaliation
  • Failure to Promote
  • Breach of Contract

Abuse & Molestation Insurance

Provides coverage for claims alleging sexual abuse or physical molestation perpetrated by an employee, volunteer, or agent of the educational institution (e.g., teachers, coaches, dorm supervisors).

This is critically important for schools given their responsibility for the safety and well-being of students, particularly minors. It covers legal defense costs and damages.

Management Liability

What is Management Liability?

This is an overarching category that typically combines several coverages for an institution’s leadership and governing body.

Directors & Officers (D&O)

Protects the personal assets of an institution’s board members, trustees, and senior administrators from lawsuits alleging “wrongful acts” in their management capacity (e.g., breach of fiduciary duty, financial mismanagement, misrepresentation, regulatory non-compliance in areas like Title IX, FERPA, or accreditation).

Other Types of Management Liability Insurance

  • EPLI
  • Fiduciary Liability
  • Crime
  • Cyber

Crime Insurance

What is Crime Insurance?

Protects the educational institution from financial losses due to various criminal acts.

Some Criminal Acts Covered by Crime Insurance

  • Employee dishonesty (theft of funds or property by a staff member
  • forgery
  • alteration
  • theft of money/securities on or off premisis
  • robbery
  • safe burglary
  • computer fraud

Employee Benefits Liability

What is Employee Benefits Liability (EBL)?

EBL protects the Institution from out-of-pocket expenses arising from errors or omissions in the administration of employee benefits programs, including health, life, disability, retirement, and many other benefits.

Examples of Covered Benefits Errors

  • Failure to enroll an employee in health insurance plan benefits
  • Incorrectly calculating retirement plan contributions
  • Providing erroneous information about employee benefit eligibility

Why is this important for Educators?

If you are providing any level of employee benefits at your Institution, errors are often unavoidable. To prevent large out-of-pocket expenses, EBL coverage can help protect your Institution.

Excess/Umbrella Liability

What is umbrella or excess liability coverage?

  • Liability coverage to sit in addition to the limits of liability present in General Liability, Auto Liability, Employers Liability (workers’ compensation), Professional Liability, Product Liability, Cyber Liability, and/or Liquor Liability (considered “underlying” policies)
  • Umbrella is considered an “overlying” policy that takes effect once the limits of the underlying policies have been exhausted
  • Example: if we have a $1 million limit per occurrence on General Liability, any claim that exceeds that amount would incur out-of-pocket expenses without the umbrella. With an umbrella policy, any amount over the underlying policy limit would be covered up to the amount of coverage selected by the umbrella policy

Why do Educators need this coverage?

  • Average General Liability claim can easily exceed $1 million in total cost (including damages, legal/defense costs, etc.), and the umbrella ensures you are protected against out-of-pocket claims expenses
  • Litigation has become more common in today’s landscape – umbrella/excess liability coverage further insulates your business and assets from legal action

Cyber

Since the pandemic, the insurance industry has seen a significant increase in frequency of claims on Cyber Insurance policies.

Whether Business Email Compromise, Ransomware, or Electronic Funds Transfer fraud, it’s more important than ever that you cover not just your own sensitive information, but that of your customers.

The two main segments of Cyber Insurance are:

First Party Cyber Insurance

  • Covers your business’ direct losses from a cyber incident affecting your own systems, networks, or data
  • Among other coverages, First Party Cyber Insurance provides relief from financial losses, data and asset recover, crisis management

Third Party Cyber Insurance

  • Provides liability protection in case a data breach or cyber incident at your company leads to claims or lawsuits from external parties
  • Protects your business from financial liabilities and legal expenses resulting from harm caused to clients, vendors, or other third parties due to a cyber incident involving your systems
